One of the greatest objects of judicial activity and academic commentary in European Union (EU) law has been the free movement of goods. The free movement of goods continues to generate intense debates because it is at the intersection of complex and difficult choices between public regulation and market freedom, on the one hand, and EU and state powers on the other. This chapter provides an overview of such debates and how they affected the development of EU law on the (...) free movement of goods. It uses the General Agreement on Tariffs and Trade (GATT) to identify some specificities of the European system. Under the GATT, discrimination tests are preceded by a market equivalence analysis of the relevant products, requiring an economic and empirical analysis of the market prior to determining whether the products are subject to differentiated treatment. Covid-19 brought back memories of past pandemics. In society, a pandemic imaginary was installed, framing an imaginary landscape, alongside a rationalized pandemic intellect to which the media contributed a lot. We live immersed in tele technologies, adding present to the past and past to the present. At a time when home confinement became the rule, this was even more highlighted. In this screen technological Era, social practices were even more subject to the five great sociotechnical effects that condition information and (...) the way it articulates memory and the present: ubiquity, instantaneity, acceleration, mobilization and presentism. This article intends to demonstrate the presence of the imaginary of past pandemics in the present (Applying Einstein's Theory of General Relativity), the way in which we appropriate these memories to create solutions and the way in which we mix the present with the solutions that came from the past. Jean Greisch3 (1942-), ainda pouco conhecido no Brasil, é um filósofo e professor luxemburguês. Realizou seus estudos em filosofia e teologia em seu próprio país, completando-os com um doutorado em filosofia, no Instituto Católico de Paris, onde defendeu sua tese sobre Martin Heidegger. Suas principais pesquisas estão relacionadas com as problemáticas contemporâneas da ontologia, da hermenêutica e da religião. Em A idade hermenêutica da razão, instigado em como a hermenêutica se inseriu no coração da filosofia ao ponto de hoje tratarmos (...) como corrente filosófica o que, antes, era uma disciplina auxiliar, Greisch analisa três sentidos possíveis da expressão razão hermenêutica: (i) o sentido descritivo, onde é realizada uma investigação histórica; (ii) o sentido crítico, onde se analisa os debates que envolve tal expressão; (iii) o sentido heurístico, onde ele questiona o quanto esta expressão implica ou não em uma ideia própria de razão. The documentary genre is one of the audiovisual mechanisms with the greatest media efficiency in the transmission of reality. However, depending on the nature of the story, the construction of the textual and audiovisual discourse is altered. In this article, we consider the following questions: Is the documentary a format that is faithful to reality? What modifications does the discourse undergo so that the story is enhanced? To go deeper into this aspect, we intend to analyse the different elements that (...) make up the documentary discourse in its transition from reality to fictionalised narrative. To this end, an inspection of the environmental dissemination documentary My Octopus Teacher (Netflix, 2020) will be carried out. An audiovisual proposal in which the coexistence between human and animal life turns environmental dissemination into a powerful instrument for transmitting scientific knowledge. (shrink)

Our goal was to explore self‐care practices among men who have sex with men in the context of Mpox in Brazil. This study used qualitative research methods, including interviews and thematic analysis, to collect and analyze data from male participants across the Brazilian territory. The narratives unveil men's perspectives on self‐care, risk reduction, and health beliefs during the Mpox pandemic. Our findings highlight a multifaceted approach to self‐care among men, encompassing hygiene, physical contact management, mask usage, skin lesion vigilance, and (...) adherence to official guidelines. Men's attitudes toward sexual behaviors emphasize the importance of reducing sexual partners, practicing safe sex, and combating misinformation through accurate information dissemination. The development of these behaviors and self‐care practices can be facilitated by nurses guided by Dorothea Orem's Self‐Care Theory, supported by patient‐centered care, with strategies to address and confront the stigma associated with the disease and provide emotional support. Thus, the study underscores the pivotal role of self‐care in mitigating infection risks, especially in the context of emerging infectious diseases. It acknowledges the impact of socio‐cultural factors and healthcare policies on men's preventive measures. However, it also recognizes limitations, such as potential bias due to stigma concerns and a nonrepresentative sample. Ultimately, the research advocates for tailored education, promotion of gender equity, and healthcare empowerment to effectively manage health risks in such contexts. (shrink)

Por meio do estudo bibliográfico e jurisprudencial, buscou-se definir o conteúdo do direito à liberdade de expressão e o seu exercício através da internet. Em seguida, passou-se a examinar o polêmico Inquérito das “fake news” (4.781 DF), do qual emanaram-se decisões colidentes com as garantias conferidas à liberdade de expressão. A teologia esforça-se por repertoriar e sistematizar o que a revelação e a fé trazem ao crente sobre o problema do sentido da história, da peregrinação através do tempo da humanidade pensada em seu conjunto. Ela enfatiza, não tanto o conhecimento, mas o estado espiritual de felicidade ao qual a humanidade deve ascender antes do fim da vida na terra. Os modernos não aceitam a proposta teológica e têm por ambição descentralizar a história tradicionalmente ordenada por uma visão cristocêntrica do (...) mundo. O historiador, isentando-se da facção, assume o discurso racional sobre a trajetória dos humanos a partir de um novo núcleo referencial interpretativo, a saber, a ideia de humanidade. Voltaire apresenta-se como legítimo representante dessa perspectiva. A história sob o prisma voltairiano é colocada como problema e não como dogmática com características de uma aquisição definitiva. O problema histórico é o de compreender o mundo atual e a humanidade nele inserida. O objetivo, portanto, do trabalho foi apresentar a proposta teológica para a história e a crítica a ela desenvolvida por Voltaire, de forma a evidenciar a originalidade da abordagem moderna do fenômeno histórico. O presente artigo propõe-se a analisar as vantagens do acesso aos documentos digitais e ao mesmo tempo, apontar desafios encontrados ao pesquisar em documentos impressos. Neste intuito, discorre-se brevemente sobre uma experiência vivida ao pesquisar em acervos físicos e digitais em bibliotecas portuguesas. Como fundamentação teórica, busca dar ênfase aos documentos de valor histórico e ressaltar a relevância do uso da tecnologia no acesso à informação. Como resultado, o estudo permitiu constatar que o uso da tecnologia da informação aplicada ao (...) patrimônio documental oferece inúmeros ganhos tanto em relação à redução de tempo quanto aos custos empregados com a reprodução de cópias e da massa documental acumulada. Por fim, pode-se perceber que ainda é insignificante o número de instituições que investem nesses recursos, o que dificulta o acesso a esse patrimônio e consequentemente compromete o papel de responsabilidade social, o de disponibilizar os documentos à sociedade em tempo hábil. O sermão número 48, “O dia santificado” (Sermo XLVIII: Dies Santificatus), proferido em Mainz na data de 6 de Janeiro de 1445, na Festa da Epifania do Senhor, traz alguns temas de interesse na compreensão do desenvolvimento da filosofia cusana no período imediatamente posterior à obra A douta ignorância (De docta ignorantia, 1440) e As conjecturas (1442). Este sermão é citado no opúsculo A busca de Deus (De querendo deum, I, 16, 3), de 1445, como sendo a primeira tentativa cusana (...) de tratar do tema dos “modos de conhecimento” (modi cognoscendi) a partir da perspectiva do tema da “luz e das cores”, caro à tradição de comentadores escolásticos do De anima aristotélico, tentativa essa que viria a ser aprimorada no referido opúsculo. Nele, Cusa busca uma “conjectura” capaz de simbolizar a relação paradoxal de imanência e transcendência entre Deus e a criação, mediante a relação que se estabelece entre a luz sensível e as cores do arco-íris. A luz, embora explicada em suas determinações, isto é, nas cores, ainda permanece transcendente às mesmas, as complicando enquanto luz pura. Do mesmo modo, Cusa evoca o exemplo do “sentido comum” da tradição escolástica, que em sua interpretação neoplatonizante, seria responsável por “complicar” todos os sentidos. Por fim, mediante tais exemplos da luz e dos sentidos, Cusa encaminha sua reflexão à visão do “modo de ser divino”, que, segundo ele, também poderia ser intuído no exemplo do nome divino IHWH. Esse nome inominável que complica todos os nomes, assim como os exemplos tratados, simboliza aquela realidade divina que complica e explica todas as coisas. A reunião desses exemplos é abalizada por uma coleção de citações escriturais, que buscam trazer respaldo às suas interpretações. (shrink)

José de Sousa Pereira, membro do Conselho da Fazenda de D. Pedro II, foi enviado a Roma com a embaixada do Bispo de Lamego entre 1676 a 1682. Consignou as impressões da viagem A politica dos princepes de Itália em 1680, decerto com a finalidade de fornecer modelos críti­cos aos governantes portugueses. Da apreciação da política italiana ressaltam simpatias pela república veneziana, pelo Ducado de Saboia, mas também um conhecimento deficiente das políti­cas de Génova, Modena, Mântua, Parma e (...) Lucca, tão reduzida é a informação que sobre elas aduz. Fez ressaltar o peso da falta de unidade territorial da Itália, os inconvenientes do regime electivo e as vantagens do absolutismo, este através do modelo da corte papal e na participação da nobreza, ao nível dos outros Estados. Mas a sugestão utópica vai para a república, através duma idealização do regime veneziano. Diplomata como era, Pereira não enjeitou também in­teressantes observações sobre política internacional. Taking literally the concept of emotional truth requires breaking the monopoly on truth of belief-like states. To this end, I look to perceptions for a model of non-propositional states that might be true or false, and to desires for a model of propositional attitudes the norm of which is other than the semantic satisfaction of their propositional object. Those models inspire a conception of generic truth, which can admit of degrees for analogue representations such as emotions; belief-like states, by contrast, (...) are digital representations. I argue that the gravest problem-objectivity-is not insurmountable. /// [Adam Morton] It is accuracy rather than truth itself that is valuable. Emotional truth is a dubious though attractive notion, but emotional accuracy is much easier to make sense of. My approach to accuracy goes via an account of what makes a story accurate. Stories can be accurate but not true, and emotions can be accurate whether or not they are true. The capacity for emotional accuracy, for emotions that fit a person's situation, is an aspect of emotional intelligence, which is as important an aspect of rational human agency as the intelligent formation of beliefs and desires. In this urbane and witty book, Ronald de Sousa disputes the widespread notion that reason and emotion are natural antagonists.

Emotions can be the subject of moral judgments; they can also constitute the basis for moral judgments. The apparent circularity which arises if we accept both of these claims is the central topic of this paper: how can emotions be both judge and party in the moral court? The answer I offer regards all emotions as potentially relevant to ethics, rather than singling out a privileged set of moral emotions. It relies on taking a moderate position both on the question (...) of the naturalness of emotions and on that of their objectivity as revealers of value: emotions are neither simply natural nor socially constructed, and they apprehend objective values, but those values are multidimensional and relative to human realities. The axiological position I defend jettisons the usual foundations for ethical judgments, and grounds these judgments instead on a rationally informed reflective equilibrium of comprehensive emotional attitudes, tempered with a dose of irony. This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who worked (...) on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. The word "truth" retains, in common use, traces of origins that link it to trust, truth, and truce, connoting ideas of fidelity, loyalty, and authenticity. The word has become, in contemporary philosophy, encased in a web of technicalities, but we know that a true image is a faithful portrait; a true friend a loyal one. In a novel or a poem, too, we have a feel for what is emotionally true, though we are not concerned with the actuality of events (...) and characters depicted. To have emotions is to care about certain things: we can wonder whether those things are really worth caring about. We can wonder whether our passions reflect who we are, and whether they constitute fitting responses to the vicissitudes of life. So there are two aspects to emotional truth: how well an emotion reflects the threats and promises of the world, and how well it reflects our own individual nature. That is the starting point of this book, which looks first at the analogies and disanalogies between strict propositional truth and a looser, "generic" sense of truth. As applied to emotions, generic truth is closer to those original meanings: as in a portrait's fidelity or friend's loyalty. Taken in this sense, the notion of emotional truth opens up large vistas on areas of life essential to our existence as social beings, and to our concerns with beauty, morality, love, death, sex, knowledge, desire, coherence, and happiness. Each of those topics illustrates some facet of the dominant theme of the book: the crucial but often ambivalent role of our emotions in grounding and yet also sometimes undermining our values. Emotions act, in holistic perspective, as ultimate arbiters of values where different and independently justified standards of value compete. (shrink)

Femininity and whiteness dominate Western nursing, silencing ontologies and epistemologies that do not align with these dominant norms while perpetuating systemic racism and discrimination in nursing practice, education, research, nursing activism, and sociopolitical structures. We propose Black feminist thought as a praxis to decenter, deconstruct, and unseat these ideologies and systems of power. Drawing from the work of past and present Black feminist scholars, we examine the ontological and epistemological perspectives of Black feminist thought. These include (i) the uniqueness and (...) particular experiences of people, (ii) the acceptance of ontological and epistemological pluralism of truths and ways of knowing, and (iii) the mandate for equity in the health, social, political, and environmental structures of society. By focusing our attention on lived experiences and voices of those systematically excluded in nursing practice, education, research, and society, Black feminist thought offers an anticolonial, antiracist, and antidiscriminatory foundation for more effectively upholding nursing's disciplinary mandate for social justice and equity. In this paper, I argue that, despite the progress made in recent years, virtue argumentation theory still lacks a more systematic acknowledgment of other-regarding virtues. A fuller recognition of such virtues not only enriches the field of research of virtue argumentation theory in significant ways, but also allows for a richer and more intuitive view of the virtuous arguer. A fully virtuous arguer, it is argued, should care to develop both self-regarding and other-regarding virtues. Emotions are Janus‐faced. They tell us something about the world, and they tell us something about ourselves. This suggests that we might speak of a truth, or perhaps two kinds of truths of emotions, one of which is about self and the other about conditions in the world. On some views, the latter comes by means of the former. Insofar as emotions manifest our inner life, however, we are more inclined to speak of authenticity rather than truth. What is the (...) difference? We need to distinguish the criteria of correspondence or appropriateness suitable for authenticity from those that embody the criterion of truth. Furthermore there is also a question about the transitions – among states of mind, and between states of mind and behaviour – that emotions encourage. This realm of transitions concerns rationality. After sketching the relevant distinctions, I will endeavour to justify the view that emotions should be appraised in terms of all three terms. (shrink)

In this essay, I will focus on the two main objections that have been adduced against the moral acceptability of contempt: the fact that it embraces a whole person and not merely some deed or aspect of a person’s character, and the way that when addressed to a person in this way, it amounts to a denial of the very personhood of its target.

Müller argues that the perceptual or “Axiological Receptivity” model of emotions is incoherent, because it requires an emotion to apprehend and respond to its formal object at the same time. He defends a contrasting view of emotions as “Position-Takings" towards “formal objects”, aspects of an emotion's target pertinent to the subject's concerns. I first cast doubt on the cogency of Müller's attack on AR as begging questions about the temporal characteristics (...) of perceptual events. I then argue that Müller's version of PT is not radical enough. On my attitudinal view, formal objects are not values but natural properties that justify specific affective or behavioral responses. Values are constituted only by a negotiated social aggregation of individual evaluative attitudes. (shrink)

How should we understand the emotional rationality? This first part will explore two models of cognition and analogy strategies, test their intuition about the emotional desire. I distinguish between subjective and objective desire, then presents with a feeling from the "paradigm of drama" export semantics, here our emotional repertoire is acquired all the learned, and our emotions in the form of an object is fixed. It is pretty well in line with the general principles of rationality, especially the lowest reasonable (...) principles. Turned to the second part of this side of reasonable. I will inquire how emotional beliefs, desires, and behaviors contribute to the rationality. I will present a very general biological hypothesis: emotions by controlling highlights the characteristics of perception and reasoning, so that we remove the difficulties due in particular to lead to paralysis; they are being simulated by a simplified perception of information, thus limiting our practice and cognitive choice. How are we to understand emotional or axiological rationality? I pursue analogies with both the cognitive and the strategic models, testing them against intuitions about emotional desires. We distinguish two different classes of desires, the subjective and the objective, and propose that emotions have a semantics that derives from "paradigmatic scenarios", in terms of which our emotional repertoire is learned and the formal objects of our emotions fixed. This fits in well with emerging facts about how our emotional capacities develop, and it can also be squared with the general principles of rationality, particularly minimal rationality. In the second part, I return to the perspective of rationality. I ask how emotions contribute to the rationality of beliefs, desires, and behavior. I proffer a very general biological hypothesis: Emotions spare us the paralysis potentially induced by a particular predicament by controlling the salience of features of perception and reasoning; they temporarily mimic the informational encapsulation of perception and so circumscribe our practical and cognitive options. Este artigo visa analisar a narrativa (auto)biográfica de estudantes de Pedagogia em uma universidade pública da região do Vale do São Francisco, localizada no território de Petrolina-PE em contexto de pandemia da COVID-19. Para refletir sobre a formação a partir da escrita de si, pautamo-nos, teórica e metodologicamente, em Heidegger, Josso, Freire, Ribeiro, Passeggi, Sousa e Lima. Neste artigo, comtempla-se respostas referentes à como os estudantes se sentiram no processo de formação docente em meio a pandemia e o que (...) esperavam do futuro. A turma do curso de Pedagogia era composta por 19 estudantes, deste total, 17 participaram da atividade da escrita da carta a si. Como estratégia de análise, utilizou-se o método do círculo hermenêutico “heideggeriano”. Assim, as informações foram organizadas em três temas de sentido, sendo: saúde mental na pandemia; ensino remoto versus ensino presencial; e planejamento de carreira. Percebeu-se, por meio das cartas, a preocupação quanto ao ensino remoto, assim como os planos de futuro, com intenção contribuir socialmente para uma educação humana e facilitadora de aprendizagens. Notou-se, ainda, que os estudantes refletiram sobre o bem-estar na profissão, buscando o sentido de suas ações, além de demarcarem o suporte financeiro, emocional, familiar e formativo. (shrink)

In _The End of the Cognitive Empire_ Boaventura de Sousa Santos further develops his concept of the "epistemologies of the south," in which he outlines a theoretical, methodological, and pedagogical framework for challenging the dominance of Eurocentric thought. As a collection of knowledges born of and anchored in the experiences of marginalized peoples who actively resist capitalism, colonialism, and patriarchy, epistemologies of the south represent those forms of knowledge that are generally discredited, erased, and ignored by dominant cultures of (...) the global North. Noting the declining efficacy of established social and political solutions to combat inequality and discrimination, Santos suggests that global justice can only come about through an epistemological shift that guarantees cognitive justice. Such a shift would create new alternative strategies for political mobilization and activism and give oppressed social groups the means through which to represent the world as their own in their own terms. O presente trabalho pretende resgatar o debate entre Richard Rorty e Nancy Fraser, ocorrido no início da década de 1990, especificamente a partir do texto Feminismo e Pragmatismo apresentado na Tanner Lectures on Human Value. Nesta conferência o filósofo discorreu sobre a possibilidade de conciliação entre o seu pragmatismo e o feminismo. Rorty aborda o feminismo enquanto autocriação da mulher através da “redescrição” mediante a manifestação poética, onde o filósofo encara as feministas como criadoras do novo. Em seguida, exporemos a (...) crítica de Fraser, que trabalha sobre a proposta apresentada pelo pragmatista e que oferece suas próprias ideias dentro de uma concepção do feminismo como movimento democrático de massa. Ao final, uma breve avaliação das implicações das críticas e sugestões apresentadas por Rorty ao feminismo e também da resposta de Fraser. (shrink)

Résumé Cet article analyse les luttes menées par des casseuses de noix de babassu pour leurs territoires dans l’État de Maranhão, au Brésil. L’analyse est basée sur les réflexions de deux femmes noires casseuses de noix de babassu et sur les témoignages de Maria do Rosário et Rosalva Gomes.
